جريمة استهلاك المخدرات بين العقوبة و التدبيرفي ظل التشريع الجزائري

Abstract

The drug consumption is one of the most serious crimes which threaten both the individual and the society in all fields including healthy,psychologicial,social and economic field. In spite of the legal texts applied to fight against this fenomenon throught the usual penalties that are intented to achieve deterrence and repression; this phenomenon is increasing considerably over time becoming a worrying and alarming state. It affects more the youth. In view of the lack of sanctions implementation on this dangerous phenomenon,i twas necessary to find another way that does not entirely deny the penalty; however, it completes its faults which are prescribed as long as by the algerian legislature in the first article of the criminal code those are the security measures. As well as the code of drugs has made these proceeding in the crime of consumption as independent from other crimes drugs in order to prevent and treat this phenomenon from its origins taking into consideration the personalty of the consumer and the revelation of his gravity of the underlying criminality inside this person to ensure that this phenomenon will be treated, on which the modern criminal policy has insisted .
