dc.description.abstract |
This study comprises two parts which appear to be of a certain complementarity and making the unicity of the bearing subject on the fundamental principles of the modes of the civil service and the evolution of their applications in the Algerian one.
The first chapter consists in an increasingly conceptual approach the theoretical aspect forming the rules and the common principles adopted by the sets of the modes of the civil service through a good number of states having some semblance ideologically-juridically speaking.
The second chapter is being “ a case study “ of the made of the civil service in Algeria which was evoked in the form of evolutionary approach in time, i.e. to see the evolution of the Algerian legislation in the broad sense of the term –in the field of the civil service from independence to the last legislative text governing the civil service knowing the ordnance n° 06/03 of July 15, 2006
Currently still implemented. In addition, it is to specify that this study comprises references as a comparison to other legislative experiments in particular that of France, Egypt and in a less degree Syria and Jordan.
This bipartite approach was obviously based on the structural element of the study by a plan including two sections, each of which is divided into two parts, and balanced as the accustomed by a conclusion containing the outputs that have been resulted from this study.
Furthermore, it contains a certain number of personnel appreciations that I allowed to myself to add.
This thesis does not constitute a new contribution in the field of the administrative law, and the right of the civil service in particular. It can not be regarded as a simple analytical approach of the Algerian mode of the civil service through its variants phases, but which always remains imprisoned by a political vision centred primarily on the social aspect. This means that the civil service in Algeria through the variants periods was not an ultimate end in itself; quite to the contrary, it was always used as means of regulation of the social climate in Algeria.
That leads us to recognize the extreme importance of the mode of the autonomous and reliable civil service as being able to bring a guarantee to the government officials, so that to fulfil their mission of the public utility, the principal mission of the state, and this is the total respect of the principals of the neutrality of the public administration, a neutrality which must be posted with the regard and political powers in exercise and damaged ordinary – citizens.
Considering this influence, the current mode of the civil service in Algeria still requires a change so that to enable it to have a certain distance to see even an autonomy with regard to all what is olitical for being better devoted to the administrative whole. |
