Abstract

Child protection law 12-15, which the Algerian legislator initiated in 2015, to adopt it as a principle for the treatment of child offenders and their reintegration, is one of the most important achievements of legislative policy. This takes into account modern data from the criminal, social and human sciences. The latter see in the delinquent child a victim of environmental and personal factors affecting his behavior and his conduct, due to the lack of intellectual maturity and sufficient awareness to allow him to control the circumstances and factors that affect him. This finding necessitated special treatment of the delinquent child during this period of his life because of his need for a distinct method to prevent him from being drawn into the current of deviation and contact with other criminals, which leads to the perversion of his morality and his attraction to crime. All the procedures and measures undertaken against the child offender must take into account his personal condition and the requirements of his protection, his care and his return on the right path. When his situation is favorable, he becomes a useful individual for society in his future life. For this reason, the legislator has approved, in accordance with the aforementioned law in chapter three, the measures concerning child delinquents and by which it has organized and stipulated separate procedural provisions, which have been divided into different stages through which the delinquent child passes. ; From the investigation, to the trial, to the appeal of judgments and up to the stage of the punitive execution of the delinquent child.
