Abstract

Public utility expresses the extent of the state and local groups interference in economic,social,political and cultural life …wich leads the Citizen to sense how close or far the state and its bodies are from him in view of the size and quality of the services provied to him . And in the current era characterized by globalization markets ,intense competition the proliferation of media and modern communication technologies, and the emergence off new such as modern management and good governance, all of wich made the public utility in algeria facing major challenges that forced it to raise the level of performance of public services provided to citizens before it higher levels of efficiency,effectiveness and quality . Accordingly,it has become necessary to reform and modernize the methods of conducting public utilies in algeria to keep pace with global and regional developments and take into account societal transformations, with the aim of increasing the efficiency and effectivencess of public activity . Since the 1990,the algerian state has embodied the new privatization policy, which includes activities of a utility nature ,by adopting a legal technique called the public utility mandate,which takes the form of two forms : the unilateral authorization and the consensual delegation.
