Abstract:
The use of commercial advertising has become an absolute necessity imposed by the economic evolution to achieve the promotion of products and services, using various advertising tools to spread the advertising message. This activity has been regulated by a set of laws and decrees, which have defined the definition of commercial advertising, its elements and characteristics, as well as the effective establishment of regulatory bodies that carry out tasks of indirect control over advertising activity in order to stop and exclude advertising messages contrary to the principles and rules in force. out. And the case does not stop only at the preventive aspect, but also the advertising activity is regulated by the deterrence that occurs when committing any of the violations and offenses related to commercial advertising. The study showed the weakness of their effectiveness in taking into account the crimes committed and the inclusion of sanctions aimed directly at repressing the crimes, and therefore it must be said that the points related to this activity must be taken care of through the promulgation of a special law relating to the regulation of commercial advertisements from its promulgation to the penalties and sanctions established in the event of violation of the legal texts.
