Abstract

Through our study for the subject of co_ownership in the reinforcement of practical reality and legal legislation , we found a set of gaps and deficiencies that require the intervention of the algerian project in order to correct and address them The treatment of the condominium system has given rise to many problems and although it is presented in court has not been published as an article or precedent to take advantage of overlapping jurisdictions , especially in large cities ,which has led to litigation , collateral constraints have made the application of the aforementioned decree² 99 /14 has limited the legal difficulties that have led to an increase in the charges of the administrator and the association In any case and in order to avoid all the problems that may arise between the owners and occupants as neighbors of each other , and so that the condominium serves as a spacious space of coexistence and cohabitation between them in the best conditions , and to mainthain the proper functioning and maintenance of the building , we note that the legislator has taken care to set prescriptions that do not concern the right of ownership in itself , and do not regulate the form and specifications of the building , but rather regulate the relations between the co_owners , and explain how they use the private parts of each two, and the parts that are common to them and how to manage the property so that they can live in it without problems and conflicts , and ensure transparency in the management of the condominium
