Abstract

The procedural rules of the International Criminal Court is the first international procedural document, comprehensive and most important balance between the major systems in the world (the Anglo-Saxon system-Latin system) deriving their provisions from the advantages of these systems and omitting some of their disadvantages. This intermixture resulted a creation of a unique procedural system of its kind, giving a considering balance at the legal level among the “adversarial” and “inquisitorial” systems techniques, by integrating elements of both systems in order to prepare a consistent set of international rules aimed at the achievement of international criminal justice, but this system is punctuated by some defects and shortcomings that needed to be re-examined, especially in some of its procedures in order to achieve a balance away from any other considerations, even though most of the defects were more political than legal.
